Welcome to this year’s final issue of Insight from Hindsight, the quarterly e-journal of the Navigant Construction Forum™ focusing on construction and dispute related issues in the global construction community. This issue features six articles focused on the topic of Concurrent Delay in construction contracts around the world.
Concurrent Delay is an industry term that has been defined and ruled upon in scores of disputes around the world, however, the definition is somewhat dynamic and often open to interpretation. This Global Tour of Concurrent Delay” showcases different insights and perspectives from countries around the world. Our journey into the subject begins with a comparison of U.S. and U.K. laws and the impacts of AACE protocols in U.S. court decisions. Moving south, our authors highlight three South American countries and their approach to concurrent delay. Finally, we take a look into the Middle East, Asia, and Asia Pacific courts and how each define and rule on this somewhat ambiguous subject.
