The &amp;ldquo;Abuse of RFI Process&amp;rdquo; examines how contractors misuse RFIs in order to increase profits, a practice that has become widely institutionalized in the past decade. &amp;ldquo;RFIs in Action&amp;rdquo; applies that framework in the context of a claim case involving a laboratory building at a wastewater treatment facility. &amp;ldquo;Legal Decisions Concerning the Number of RFIs&amp;rdquo; examines the legal argument for cumulative impact as a result of a large quantity of RFIs. Finally, &amp;ldquo;Owners are Part of the Problem&amp;rdquo; explains how owners contribute to the abuse of RFIs by failing to adopt practices that contractually safeguard against the potential negative impacts of the RFI process.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The next section discusses how to reduce both the number and the impact of RFIs on future projects. The Navigant Construction Forum&amp;trade; developed a framework that consists of three principal recommendations: First, the &amp;ldquo;Incorporation of Critical Definitions&amp;rdquo; identifies the specific definitions that should be articulated in the contract documents to prevent misunderstanding between owners and contractors. Second, &amp;ldquo;Electronic RFI Tracking and Monitoring&amp;rdquo; outlines the software applications that owners may wish to employ to optimize project management and to increase productivity. It is significant that seven Chinese companies are among the Top 15 largest turbine suppliers in the world. During 2011, five Chinese companies exported 140 wind turbines to five different foreign markets.&lt;br&gt;&lt;br&gt;However, the market conditions for wind power in China have changed dramatically since 2011. Local transmission build-out can't keep up with wind farm installations, and fierce price competition due to overcapacity has translated into lower volumes and lower margins. In addition, the central government's stricter project approval process signaled tougher market conditions for local players. 2012 will prove to be a difficult year for Chinese turbine OEMs, as evidenced by the poor performance of stocks in the 1st half of the year. It is expected that 2012 will see Chinese wind installations dropping further. This presentation will provide an update of the market dynamics and will inform attendees what is exactly going on in China. At this time, GLNG submitted to the Department of Energy (DOE) Office of Fossil Energy an application for long-term authorization to export up to 11.5 million tons per annum of liquefied natural gas (approximately 1.5 billion cubic feet of gas per day) from domestic sources for a 20 year period. The project is scheduled to commence deliveries at the end of 2018 from a terminal to be located in Jackson County, Mississippi, near the City of Pascagoula, MS. &lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;h4&gt;&lt;span style="color: #4f81bd;"&gt;&lt;strong&gt;Successes&lt;/strong&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp; &lt;/span&gt;&lt;/h4&gt;&lt;p&gt;Navigant&amp;rsquo;s work for the American Clean Skies Foundation in 2008, established Navigant as a reputable leader in the area of natural gas shale and unconventional gas in North America. By mid-2010, Cheniere Energy engaged Navigant to provide an analysis that would be used by Cheniere for its ground-breaking application to the DOE for approval to export of LNG from Cheniere&amp;rsquo;s Sabine Pass LNG export project in Texas.&amp;nbsp; Despite several other DOE applications that have been submitted since, including the current GLNG application this year, the Cheniere Sabine Pass LNG export project remains the only LNG export project to have received DOE approval to export to non-Free Trade countries. &lt;em&gt;Navigant&amp;rsquo;s successful analysis played an instrumental part of the favorable DOE Cheniere decision and the &amp;ldquo;lessons learned&amp;rdquo; from Cheniere will hopefully carry forward as part of the GLNG project application, as well as several other LNG export projects, that are currently before the DOE pending a decision.&lt;/em&gt;&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;h4&gt;&lt;span style="color: #76923c;"&gt;&lt;span style="color: #4f81bd;"&gt;&lt;strong&gt;Expertise&lt;/strong&gt;&amp;nbsp;&amp;nbsp; &lt;/span&gt;&lt;br&gt;&lt;/span&gt;&lt;/h4&gt;&lt;p&gt;In addition to the successful Cheniere Sabine Pass application, Navigant has supported seven other U.S. LNG export projects, including the GLNG project, to provide similar in-depth analyses on the construction of LNG export facilities.&amp;nbsp; As such, Navigant has become a recognized leader in the area of providing independent third party market impact studies for LNG project developers planning on filing applications for the export of LNG to the DOE. Navigant has assisted these large infrastructure projects that range in size from capital costs of $3 Billion to $10 Billion by using its proprietary natural gas market modeling and forecasting tools. The Federal Government and their Provincial counterparts are examining options to maximize value creation for Canada, due to the magnitude of changes in the North American energy mix and supply patterns. &lt;/p&gt;
&lt;p class="Default"&gt;British Columbia has requested further analysis of two options: &lt;/p&gt;
&lt;ol&gt;
    &lt;li&gt;Exports of bitumen in large cargoes (up to VLCC) to refiners in Asia; or &lt;/li&gt;
    &lt;li&gt;&amp;nbsp;Processing in a greenfield refinery at Kitimat in British Columbia, from which smaller cargoes of fuel products would be exported to customers in Asia or elsewhere on the American continents. &lt;/li&gt;
&lt;/ol&gt;
&lt;p class="Default"&gt;To assist the Province of BC with its assessment, Navigant was retained to prepare a technical review, including an estimate the likely economic performance of the refinery, as well as, compile an assessment of the Asian fuel supply/demand balance and whether the output from Kitimat could be sold profitably to customers in four Asian countries. &lt;/p&gt;
&lt;p class="Default"&gt;One of the key objectives of the study was to estimate the economic performance of the refining option, in light of contraction of the industry in the US. Another essential element is to examine is the potential to sell the output from Kitimat in Asian countries. &lt;/p&gt;
&lt;p&gt;This study was based on a review of documents and literature in the public domain, certain information and sources of information available to Navigant and the knowledge and experience of the author. &lt;/p&gt;

Along the same lines, for many years the industry has been working to develop natural gas fueling of vehicles, to displace oil-based fuels. Both initiatives have found some hurdles to overcome.  &lt;/p&gt;

Alongside the optimistic view that winter will surely end soon, we&amp;rsquo;d like to take this opportunity to reflect on our predictions of the last year and share new insight on the issues we believe will be shaping the industry this spring and beyond.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;In 2012, we proposed three main themes:&lt;/p&gt;
&lt;ol&gt;
    &lt;li&gt;&lt;span style="text-decoration: underline;"&gt;Eurozone Instability&lt;/span&gt;: Against a backdrop of market volatility and with lack of momentum as the new normal, we singled out the Eurozone crisis from amongst a myriad of global threats, predicted a high probability of a &amp;lsquo;Grexit&amp;rsquo; and therefore the need for our clients to prepare robust contingency plans&lt;/li&gt;
    &lt;li&gt;&lt;span style="text-decoration: underline;"&gt;Profitability Squeeze&lt;/span&gt;&lt;span style="text-align: justify;"&gt;: We also anticipated changes in demand to investment strategies, impacting on revenues at a time of increasing costs. As a result, we predicted a sustained squeeze on profitability which would eventually prompt firms to review their business models&lt;/span&gt;&lt;/li&gt;
    &lt;li&gt;&lt;span style="text-decoration: underline;"&gt;Regulatory Impact&lt;/span&gt;&lt;span style="text-align: justify;"&gt;: Finally, we predicted that regulation would occupy much time and effort, forcing change on the industry with RDR re-shaping the Retail Distribution landscape, then MIFID II &amp;amp; FATCA forcing firms to take an increasingly global outlook&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;
&lt;p style="text-align: justify;"&gt;Our first prediction was perhaps premature. Global risks would appear to have receded at the end of 2012. Thankfully a Grexit did not occur; the US avoided its Fiscal Cliff and China a hard landing. After a partial market recovery in January, talk is of a great rotation into risk assets in an ongoing search for yield. However, we believe that uncertainty and volatility will continue into 2013. Tensions still abound, with risks, whether from regional conflict between Japan and China to currency manipulation by the major Central Banks, likely to spill over into markets. European economies continue to diverge, with ever higher levels of unemployment in some countries fuelling political risk. Having helped our clients with their Euro-melt down contingency planning in 2012, we are firmly of the view that planning against a wildcard event in the Eurozone is still a prudent course of action for 2013.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Our second prediction was more accurate. Throughout 2012, we saw growing evidence of changes in demand for investment strategies gathering pace. Last year saw increased net flows into Passive and ETF strategies at one end of the spectrum, and Multi-asset and Outcome based solutions at the other, largely at the expense of underperforming active Equity strategies. Across the Institutional &amp;amp; Retail Distribution spectrum, we saw increased concentration of net flows into a select group of managers. Firms caught in the squeezed middle have indeed begun to restructure to meet the challenge.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Finally, 2012 did indeed see our clients cite regulation among their top priorities; predominantly RDR, MIFID II, AIFMD and FATCA. A great deal of our focus in the second half of 2012 was in helping our clients&amp;rsquo; position for RDR. With the others, many are waiting to see how developments unfold in 2013, being somewhat sceptical of the timelines presented by the regulators.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;&lt;strong&gt;So what do we think the big themes will be in 2013?&lt;/strong&gt;&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Firstly, firms will continue to restructure in light of the market challenges listed above. We expect focus in three areas:&lt;/p&gt;
&lt;ol&gt;
    &lt;li&gt;&lt;span style="text-decoration: underline;"&gt;Ongoing market strategy&lt;/span&gt; reviews to ensure that market positioning and resources are focused around core competencies and away from unprofitable or waterfront propositions. We expect to see the outcome of these reviews impacting on product development functions, the front office and distribution footprints.&lt;/li&gt;
    &lt;li&gt;&lt;span style="text-decoration: underline;"&gt;Product innovation and development&lt;/span&gt;&lt;span style="text-align: justify;"&gt; in a bid to maintain margins and combat decline in net flows to underperforming products. We expect to see investment solutions gain at the expense of component manufacture, and more innovation around outcome based solutions. Given the regulators stated interventionist stance on product development, we anticipate helping our clients to rise to the challenge to ensure that product development functions and&amp;nbsp; process are both fit for purpose and that new product launches are well positioned and managed.&lt;/span&gt;&lt;/li&gt;
    &lt;li&gt;&lt;span style="text-decoration: underline;"&gt;Customer Experience focus&lt;/span&gt;&lt;span style="text-align: justify;"&gt;: With firms positioning their Retail Distribution channels and footprint for the post RDR world, we expect to see both development to and launch of new direct to customer and guided platform propositions over the coming year, in anticipation of the direct market gaining ground at the expense of advisers. In tandem, we expect that customers will become more confident with guided solutions and become less willing to pay fees for simple transactions. Those intermediary platforms in a position to invest will respond to strengthen value-added customer propositions with outsourced investment solutions and sophisticated adviser tools. Consolidation is on the cards for those platforms unable to invest to differentiate or gain scale in a crowded market.&amp;nbsp;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;
&lt;p style="text-align: justify;"&gt;In a repeat of 2012, &lt;strong&gt;regulation&lt;/strong&gt; will continue to soak up managers&amp;rsquo; time, effort and resources:&lt;/p&gt;
&lt;ol&gt;
    &lt;li&gt;&lt;span style="text-decoration: underline;"&gt;Outsourcing&lt;/span&gt;: Already in January, we have seen the latest FSA &amp;ldquo;Dear CEO&amp;rdquo; Outsourcing letter ruffle feathers. We expect to devote significant effort to help shape how the industry can respond&lt;/li&gt;
    &lt;li&gt;&lt;span style="text-decoration: underline;"&gt;RDR &amp;amp; &amp;ldquo;TCF on steroids&amp;rdquo;&lt;/span&gt;&lt;span style="text-align: justify;"&gt;: As RDR beds in, managers will look to their positioning for the end of 2013 when all rebates will cease. The FCA will be looking closely at sales of non-regulated and non-advised products with a view to widening the remit of RDR&amp;nbsp; to ensure that all customers are treated fairly&lt;/span&gt;&lt;/li&gt;
    &lt;li&gt;&lt;span style="text-decoration: underline;"&gt;Euro &amp;amp; global influence&lt;/span&gt;&lt;span style="text-align: justify;"&gt;: Alongside RDR, other topical regulations include MiFID 2 effects across Europe, the likely increased focus from the FCA on cultural and governance improvements and the AIFMD and UCITS V regulations forcing administrators and custodians to take on more risk.&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;
&lt;p style="text-align: justify;"&gt;Last but not least, data issues will come to the fore. This year may well be the time in which restrictive data architecture is finally considered as a business problem. According to a group of experts that Navigant assembled from across the industry late in 2012, data issues can no longer be seen just as a technology problem. Some predicted that 70% of their Change spend in 2013 would be on data-related projects.&lt;/p&gt;

While the industry generally recognises this point, the scale is often underestimated: requests for data from the Business has grown to such an extent that one of the companies present predicted that 70% of their Change spend next year would be on data-related projects.&lt;/p&gt;
&lt;p&gt;What has led to this increase? How can you ensure the Business understands its obligations and is willing to engage and take ownership at the Executive level?&lt;/p&gt;
&lt;p&gt;As part of our discussion a number of ideas for success emerged:&lt;/p&gt;
&lt;ol&gt;
    &lt;li&gt;Have a Data Steering Committee/Governance forum with Executive-level members present (and not just the COO); Focus should be around a set of Data Strategy principles, and communicate its successes, demonstrating to the business the value of data by delivering small, bite size chunks&lt;/li&gt;
    &lt;li&gt;Make better use of the existing Risk and Controls framework and identify which of these relates to data; Base the data governance framework around these as a first step.&lt;/li&gt;
    &lt;li&gt;Align the Change function to the data governance committee to ensure that any plans are matched by an equivalent delivery capability&lt;/li&gt;
    &lt;li&gt;Consider appointing a CDO or Chief Data Officer to oversee the Steering Committee and bring data directly on the Board agenda&lt;/li&gt;
    &lt;li&gt;Identify a burning platform &amp;ndash; Regulation, Consultant/RFP demand, Institutional client requests, FCA focus are all good examples&lt;/li&gt;
    &lt;li&gt;Use data appropriate to the product range &amp;ndash;Absolute Return or LDI-type products will require more specialist data than for example a passive, UK-only strategy&lt;/li&gt;
    &lt;li&gt;Focus on data quality. This is taken for granted in other industries. What lessons can we learn from them?
    &lt;/li&gt;
&lt;/ol&gt;
&lt;p&gt;&lt;strong&gt;Data Governance&lt;/strong&gt;&lt;em&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;em&gt;Is it time to consider a separate Data Change team? &lt;/em&gt;A robust Data Governance framework supported at the Executive level is seen by many as the most important factor in driving towards a successful data-centric model. Aligned to this is the need for some kind of steering committee that owns these principles and drives the Change agenda.&amp;nbsp; The shape, size and even existence of one will depend on variations in product set, cultural maturity and size; however without some kind of governance framework, it is difficult to evidence the scale of the problem, let alone craft any solutions.&amp;nbsp; One company recounted that although happy they had a strong committee, they had struggled to align their delivery ambitions with the delivery capability of the Change function.&lt;em&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;em&gt;How do we go about identifying what should be part of the governance framework?&lt;/em&gt; One suggestion is to leverage the existing Risk and Controls framework, some proportion of which will be data related. One firm estimated that 147 existing controls could be co-opted in to the framework.&lt;em&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;em&gt;Who best to own this set?&lt;/em&gt; One idea from other industries is the appointment of a CDO, Chief Data Officer, whose job it is to ensure that data is owned and championed at a Board level and who chairs the Governance committee and reports on the Data Governance framework to the Executive level.&amp;nbsp;&amp;nbsp; Whether in the current economic climate any organisation would be willing to finance such a role full time is debatable, and none of the companies at the forum currently has or anticipates having such a role, even though most saw an obvious need for it.&lt;em&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;em&gt;How to get the Executive interested in Data?&lt;/em&gt; The main driver for support at the Executive was the clear visibility of a &amp;ldquo;burning platform&amp;rdquo;, the most significant of which currently is the Regulatory imperative. Solvency II and its associated data burden, as but one example looms large in the mind of many fund managers, and especially those captive managers of an Insurance company.&amp;nbsp;&amp;nbsp; Other platforms we considered were technology-led, e.g. Performance &amp;amp; Risk attribution, OMS &amp;amp; decision support, trade compliance; Institutional management mandates are increasingly given only to companies who can demonstrate robust data governance and controls. Finally, the FCA are doubtlessly considering further ways to inspect the firm&amp;rsquo;s Systems and Controls framework, and the importance of evidencing good data and associated controls is greater than ever.&lt;em&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;em&gt;How are we communicating progress?&lt;/em&gt; Finally, many commented that where they were already doing good work in this space, they were often not able to communicate this effectively or efficiently. By their own admission, many IT people are not natural communicators, and the progress made is not always visible or of interest to a broader audience. Highlighting happy Fund Managers is a good start, and CIO as well as COO representation on the Committee should provide the right conduit for successes to be enjoyed at the highest level.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Data Quality and IBOR&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;One of the many interesting comments made was that for such a fundamental industry we&amp;rsquo;re still significantly behind many others. The examples cited were car manufacturing and pharmaceuticals; both of which take for granted that their data is correct, and have worked for many years to identify efficiencies and develop processes based on very fine tolerances. They have also created data-sets matched to their product-sets, reducing the amount of overall data they capture and tailoring it to their product strategies. The analogy in our industry would be a Global Absolute Return Strategy (GARS) vs a UK LDI or long-only passive vehicle. Each requires a different kind of data and sophistication of tool-sets. Providing a GARS-style data set for a passive vehicle is arguable a waste of money and adds an unnecessary layer of control and administrative overhead.&lt;/p&gt;
&lt;p&gt;This naturally led us to the subject of IBOR or Investment Book of Records. This has recently become an Industry hot topic and in simple terms is about providing real time relevant data to Fund Managers incorporating all known and forgeable future events to provide them with the most up-to-date positions on which to make trading decisions. Many considered this as academically interesting but ultimately unnecessary. While there was widespread recognition that trading on start of day positions was less than ideal, it was difficult to see what the burning platform would be to justify the significant investment required to take IBOR to its logical extent.&lt;/p&gt;
&lt;p&gt;Ongoing Discussion&lt;/p&gt;
&lt;p&gt;In the next forum we will focus on the role the Industry can play in lobbying the vendor and data market for more affordable access to market and economic data. In an increasingly global marketplace, it is becoming ever harder to negotiate the complex contracts that data vendors put in place and not made any easier by the complexity of most systems and the difficulty in evidencing what data is being used, where, and by whom &amp;ndash; Is there any way around the unwillingness of data vendors to take liability for the quality of their data or do we need to reconcile ourselves to it?
