The Owner’s Newest Defense

Jim Zack and Emily Federico explore the issue of how concurrent delay is commonly used by contractors to defend against the imposition of liquidated damages when a project is completed late.  Further, the authors examine two recent court decisions which serve to remind owners that legal defenses can be employed to overcome allegations of concurrent delay, if those allegations are raised, for the first time, at the end of a project after the owner imposes liquidate damages due to late completion.
