International Construction Arbitration

The largest industrial and infrastructure construction projects around the world typically involve parties from many nations. Arbitration is firmly established as the forum of choice for resolving international construction disputes and claims. Successful arbitration of large, international construction disputes requires a strong working knowledge of the various forms of contract that govern the rights, responsibilities and obligations of the parties as well as an appreciation for the local laws, regulations, customs, language and cultures of the project’s host country. Our seasoned construction consultants have the requisite technical backgrounds, analytical skills, international project experience and testimony credentials to enhance our clients’ ability to achieve the best possible outcome.

Negotiating a Favorable Settlement
A US$2.59B EPC contract for two floating production storage off-loading (FPSO) vessels to be moored off the coast of Brazil experienced significant cost overruns and extensive delays. Navigant provided the fact finding and cost/quantum and schedule/programme analysis resulting in a claim requesting an extension of time, relief from liquidated damages and additional compensation to recover a large portion of the cost overruns. Navigant supported counsel and the client in the claims negotiations and dispute resolution process, which resulted in a favorable settlement for the client.
