ICC Arbitration Resolved
A $2.59b Engineering, Procurement and Construction (EPC) contract for a floating production storage and off-loading project in Brazil ran into substantial cost overruns and schedule delays. Navigant provided the cost and schedule analysis in preparation for the ICC arbitration hearing and, supported by analysis, the contractor claims were resolved prior to the hearing.

CANADA

Performing Due Diligence to Impact the Bottom Line
A large Canadian bank required a preliminary valuation and due diligence support surrounding the potential acquisition of a well recognized credit card operation. Navigant was engaged to provide insight into the income statement impact of the acquisition at different purchase prices, and thus, whether the transaction would be accretive or dilutive to earnings. Our valuation methodology and conclusions were accepted by the Bank's external auditors, regulators and the Securities and Exchange Commission.

Aiding in a Fraud Investigation
The Autorité des marchés financiers (AMF) had initiated a widely publicized fraud investigation involving a mutual fund company. Navigant was retained to serve as the financial investigator and examined more than 10,000 transactions over a period of five years in 27 different bank accounts, cross-examined 75 witnesses, presented an expert report and provided expert testimony during the two month long trial.

Retail Development
Navigant was appointed to produce an independent expert report analyzing the delays to an extension and refurbishment by a large Australian property developer. While the commission is still ongoing, Navigant's analysis has provided the High Courts in Australia with practical, clearly demonstrated solutions needed to resolve this long running dispute.

TURKEY

Costly Arbitration Avoided
A multibillion dollar dispute around payment for delays and disruption arose between a Turkish contractor and joint venture between two Japanese companies who were engaged to construct a large transportation system in the Middle East. Navigant provided valuation and risk analysis enabling an early settlement and avoided costly arbitration.

NIGERIA

Valuation Guides Amicable Settlement
An oil major completing a $10bn subsea field development off the coast of Africa was experiencing difficulties in approving a significant number of change orders relating to scope changes and claims. Navigant was appointed to undertake an independent valuation of the change orders, which exceeded $130m in value. Through the valuation the client and contractor were able to reach an amicable settlement resulting in significant cost savings for both parties.

CHINA

Damages Expert in Arbitration
A client was subject to a claim by a Chinese computer manufacturer for a deferred acquisition premium though the Chinese company was operating with negative material in the period before it was sold to the client. Navigant's team reviewed the documentation and constructed a damages calculation, delivering two expert reports and oral testimony. Although judgment is still pending, Navigant's work supported the client’s counterclaim.

UNITED STATES

Expert Analysis & Knowledge Wins in Court
Plaintiffs alleged that eBay violated Section 2 of the Sherman Act and put forth claims that eBay had a monopoly power in alleged markets for online auctions. The U.S. District Court for the Northern District of California relied upon Navigant Economics expert testimony questioning Plaintiffs' claim that they had offered methodologies capable of providing antitrust injury.

Mortgage Servicing & Loan Modification Review
Navigant Capital Advisors was engaged by a leading Wall Street firm to perform an independent evaluation of the servicing of a portfolio of securitized residential mortgage loans totaling tens of billions of dollars, as well as the review of a loan modification program being considered by the client. Navigant identified the key operational gaps and quickly developed remediation steps to curtail loss exposure and thus substantially mitigate risk.

Supporting Market Growth & Investment
Diamond Castle Holdings retained Navigant to provide a detailed market analysis of the New Jersey Solar Renewable Energy Credits. Navigant used its proprietary REC Price Estimator Tool® and Solar Market Penetration model to complete the due diligence. Diamond Castle Holdings announced its investment in KDC Solar and allocated up to $225 million in equity capital to fund the growth of KDC Solar.

Maximizing Payer Services
The state of Wyoming engaged Navigant's healthcare team for more than six years to provide services to every state agency that pays for health services. Navigant has been instrumental in implementing programs to maximize federal revenue streams to hospitals; developing a strategic plan for reimbursement that provides the legislature with information to support annual increases; and developing cost-effective programs.

RUSSIA

Valuation of Russian Businesses
Navigant was appointed to evaluate damages in an arbitration involving alleged misappropriation of business and assets between Russian companies. After receiving Navigant's expert report, the parties settled the disputes for a sum of approximately US$100 million.

GERMANY

Transfer Pricing
Navigant developed a detailed transfer pricing report for a German manufacturer in connection with a tax audit conducted by the German Federal Ministry of Finance (Tax Authority), taking account of both OECD and US transfer pricing guidelines. Navigant played an integral role in assisting the client in developing a strategy for the audit review process.

Expert Analysis Leads to Favorable Settlement
A major international contractor working on a rapid rail link project in Africa was experiencing significant delays, disruption and cost overrun issues and appointed Navigant as program and quantum experts to analyze these issues. Through Navigant's high level audit, the contractor was able to negotiate a favorable settlement without incurring the substantial costs of a disputes resolution process.

JAPAN

Reducing a Derivative Claim through State of the Art Analytics
Navigant's Financial Services team was asked to analyze $200m of a claim made on our client from major Japanese bank. Using a statistical technique applied by leading banks, Navigant advised the client on how banks would hedge interested rate risk and charge bid-offer spreads on this type of trading instrument, reducing the derivative claim by 80 percent.

MEXICO

International Arbitration Sets New Precedent
Cargill initiated arbitration proceedings against Mexico claiming its investments in the high fructose corn syrup industry were harmed by a tax imposed on imports. Navigant was retained to serve as damages expert in a NAFTA investor-state arbitration and conducted a comprehensive analysis leading to an award in the amount of $77.3 million plus interest for Cargill.
